Investigation and Hearing Process

Internal investigations will use the preponderance of the evidence as the standard. This is a legal standard that means the greater weight of evidence (more likely than not that something occurred). This is a minimal standard and is easily met.

Confidentiality

ConfidentialityAMSC recognizes that confidentiality is important. However, confidentiality cannot be guaranteed. Respect of the privacy of the individuals reporting or the accused will be maintained to the extent possible. AMSC will take appropriate corrective action whenever deemed necessary to meet the College’s responsibilities to provide a safe and non-discriminatory environment for other employees and students.


Penalties and Sanctions

Students who are found to have violated the AMSC Sexual Misconduct Policy and/or AMSC Student Code of Conduct will be referred to Executive Director of Title IX and Judicial Affairs for adjudication.

Employees who are found to have violated AMSC Policy Manual will be referred to Human Resources Services/Employee and Labor Relations.

Sanctions for employees may include employment action up to and including termination of employment.

Sanctions for students may include action up to and including expulsion from the College.
